Terms of Service

1. Acceptance of Terms

Info2Sheets is a product developed, operated, and maintained by Fenqora LLC, a Delaware limited liability company ("Fenqora," "we," "us," or "our"). By creating an account at info2sheets.com or using the Info2Sheets API, you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

These Terms incorporate our Privacy Policy, which is part of this agreement. If you do not agree to these Terms, do not use the Service.

2. Description of Service

Info2Sheets provides an API gateway that transmits data from your HTML forms to Google Sheets ("Service"). We provide the transmission layer only — we do not host, own, or control your HTML forms or your Google Sheets. We act as a data processor on your behalf when routing form submission data.

3. Data Processing and GDPR Compliance

To the extent that you use Info2Sheets to collect personal data from individuals located in the European Economic Area (EEA), United Kingdom, or other jurisdictions with applicable data protection laws:

• You are the Data Controller. You are responsible for determining the purposes and means of processing the personal data you collect through your forms and for obtaining any necessary consents from your end-users.
• We are the Data Processor. Info2Sheets does not store the content of form submissions — it routes them transiently to your designated Google Sheet. However, we do log certain request metadata associated with each submission (such as IP address, user agent, request origin, country, and payload size) for security, abuse prevention, and service operation purposes. This is described fully in our Privacy Policy.
• Your Obligations: You must ensure your use of the Service complies with all applicable data protection laws, including providing appropriate privacy notices to your end-users and ensuring a lawful basis for any personal data you collect.
• Sub-processors: We use Cloudflare (infrastructure) and Google Cloud (Sheets API) as sub-processors. By using the Service, you authorize these sub-processors.

If your use of Info2Sheets requires a Data Processing Agreement (DPA) under GDPR or other applicable law, please contact us at privacy@fenqora.com.

4. Prohibited Use

You may not use Info2Sheets for:

• Collecting sensitive personal data without adequate legal basis and appropriate safeguards, including passwords, social security numbers, payment card details, health information, or government-issued IDs.
• Phishing, fraud, or any deceptive practices.
• Sending spam or unsolicited marketing communications.
• Collecting personal data from children under 16 years of age (or under 13 in the United States) without verified parental consent.
• Any purpose that violates applicable laws, including data protection laws, consumer protection laws, or anti-spam laws (CAN-SPAM, CASL, etc.).
• Attempting to reverse-engineer, attack, or abuse our infrastructure.

We reserve the right to suspend or terminate access without prior notice if these Terms are violated.

5. Subscriptions and Billing

• Payments: Processed via Stripe. We do not store your payment card details. By subscribing, you authorize us to charge the applicable fees to your payment method on the agreed billing cycle.
• Billing Options: We offer monthly, yearly, and lifetime plans. Monthly and yearly plans renew automatically unless cancelled. Lifetime is a one-time payment granting indefinite access (subject to the Service remaining operational).
• Cancellation: You may cancel at any time through your dashboard. Cancellation takes effect at the end of the current billing period; you retain access until then. For lifetime plans, there is no recurring charge to cancel.
• Price Changes: We will provide at least 30 days' written notice before changing subscription prices. Continued use after the notice period constitutes acceptance of the new price.
• Taxes: Prices are exclusive of applicable taxes (VAT, GST, sales tax, etc.). You are responsible for any taxes applicable in your jurisdiction.

6. Refunds and Chargebacks

• Money-Back Guarantee: We offer a 30-day "no questions asked" refund on your first payment (first month, first year, or lifetime purchase). To request a refund, contact support@fenqora.com within 30 days of your purchase date.
• Renewals: Refunds are not provided for renewal charges once a billing period has started, except where required by applicable consumer protection law. If you believe a charge was made in error, contact us promptly.
• Chargebacks: If you initiate a chargeback or payment dispute with your card issuer before contacting us, we reserve the right to immediately suspend your account pending resolution. We encourage you to contact us first — we will work in good faith to resolve any billing issues.

7. Fair Use Policy

Each plan includes a monthly submission limit. Excessive use beyond plan limits may result in temporary throttling or a request to upgrade. We will contact you before taking any such action. Details are available in our documentation.

8. Intellectual Property

The Info2Sheets platform, trademarks, and all related content are owned by Fenqora LLC and protected by applicable intellectual property laws. You retain all rights to your form data and Google Sheets content. We do not claim any ownership over data you collect or store.

9. Service Availability and Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee uninterrupted or error-free operation. The Service depends on third-party services including the Google Sheets API and Cloudflare; we are not responsible for outages or failures of those services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FENQORA LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of business opportunities.
• Service interruptions caused by Google Sheets API outages, Cloudflare issues, or other third-party service failures.
• Security breaches, unauthorized access, or data loss on your end or on third-party systems (e.g., your Google account).
• Your failure to comply with applicable laws, including data protection laws, in your use of the Service.

OUR AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, our liability will be limited to the fullest extent permitted by applicable law.

11. Indemnification

You agree to indemnify and hold harmless Fenqora LLC and its members, officers, employees, and affiliates from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law, including data protection laws; (c) any personal data you collect from third parties using our Service; or (d) any claim by a third party relating to data you have collected or processed.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Informal Resolution: Before initiating formal proceedings, you agree to contact us at support@fenqora.com to attempt to resolve the dispute informally. We will try to resolve disputes within 30 days.

Binding Arbitration: If informal resolution fails, any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, rather than in court. The arbitration shall be conducted in English. The arbitrator's decision shall be final and binding.

Class Action Waiver: You agree to resolve disputes with us only on an individual basis and waive any right to bring or participate in a class action lawsuit or class-wide arbitration.

EEA/UK Users: Nothing in this section limits your right to bring a claim before your local courts or data protection authority as permitted under applicable EU or UK law.

13. Modifications to the Service and Terms

We may modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or a prominent notice on our website. Your continued use of the Service after changes take effect constitutes acceptance. If you do not agree to the updated Terms, you may cancel your subscription before the effective date.

We may also modify, suspend, or discontinue features of the Service with reasonable notice where practicable.

14. Miscellaneous

• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Fenqora LLC regarding the Service, superseding any prior agreements.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
• Waiver: Our failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights to a successor in connection with a merger, acquisition, or sale of assets.
• Language: These Terms are written in English. Any translations are provided for convenience only; the English version governs in case of conflict.
